1833 - Will of Joseph Y. Provance, Fayette Co., Pa.

In the name of God Amen, I Joseph Provance of German Township, Fayette 
County and State of Pennsylvania, being in good health of body and of 
sound and disposing mind and memory (Praised be God for the same) and 
being desirous to settle my worldly affairs whilst I have strength and 
capacity so to do, do make this my last will and testament, hereby 
revoking and making void all wills by me at any time heretofore made.  
And first and principally I commit my soul into the hands of my creator 
who gave it and my body to the earth, to be interred at the discretion of 
my executor hereinafter mentioned, and as to such worldly estate 
wherewith it hath pleased Almighty God to entrust me, I dispose of the 
same as follows, viz:  I will in the first place that all my just debts 
as may be by me owing at my death, together with my funeral expenses and 
all charges touching the proving of or otherwise concerning this my will, 
be fully paid and satisfied, which shall be done, at the proper charges 
and costs of my legatees hereinafter mentioned, each bearing an equal 
proportion of the same.  Secondly, it my will, and in conformity thereto 
I give and bequeath unto my loving wife Rachel, at my decease all my 
personal estate of every kind and description whatever, and also my will 
is, and I do appoint that my said dear wife shall have the guardianship 
and tuition of such of my children as are in their minority until they 
shall have arrived to the years of maturity respectively or so long as 
she shall continue to be sole.  And in case of her death or Marriage 
during the minority of such, my children then I will and appoint that my 
son David Provance shall have the tuition and guardianship of them, 
during such their minority respectively, who is severally entitled to the 
sole control, emolument [?] and profits arising out of their several 
bequests during the term of his or her guardianship in their minority or 
previous tto their arrival to the age of twenty-one years, and in such 
case I earnestly entreat their utmost care respectively in and about the 
moral and education of my children if any shall be left at my death.  
Thirdly I will and dispose of my home farm in manner following to wit:  I 
give and bequeath to my son David Provance Seventy acres of land, on the 
hill where he now lives.  To Uriah fifty acres also on the hill with the 
buildings where he now lives.  To Jesse fifty acres, north end in the 
bottom, on the Monongahela River, on which he now dwells.  To Benjamin 
Franklin Provance, adjoining Jesse up the river.  To Joseph, Fifty acres

which includes the orchard and the old house barn & C.  To Elisha fifty 
acres, the extreme south end up the river, the moity remaining between 
Jesse and Uriah to Salina.  And the balance or moity
remaining between 
David and Elisha to my daughter Uanna Provance.  Fourthly I
give and 
bequeath unto my son Theron my farm on Dunkard Creek, Green Cty. 
Pennsylvania containing one hundred and nine acres.  I have five hundred 
acres in Lewis County, Virginia, which I will and bequeath to the 
children of my three deceased children to wit, Joseph, Jane, and 
Elizabeth viz their children namely Uriah, Joseph,
William, Mary and 
Patience, five children each one hundred acres, and the division being 
made, my desire is that Patience has first, and the rest to take 
agreeably to Seniority choice, and the heirs of Sarah McClaine Five 
dollars current money of the U.S.  Also Fife[sic] hundred acres of land 
situate on little Kenhawa, State of Virginia, near Parkersburg which I 
bequeath to my sons Simeon and Thomas in equal shares 250 acres each.  
And also one thousand acres of land on Mill creek between the two 
Kenhivs, big and little in the state of Virginia, which I bequeath in 
manner following to my Grand children, sons and daughters of Benjamin, 
and to my youngest daughter Rachel as follows to wit:  To James Provance

one hundred acres, he having received a a[sic] stud horse price one 
hundred seventy five dollars.  To Joseph Provance one hundred and fifty, 
and to Rebecca one hundred and fifty acres, children of Benjamin.  And I

will and bequeath to my youngest daughter Rachel Four hundred acres of 
the last mentioned tract, and balance which is two hundred acres to my 
grand children, sons and daughters of Lydia, to be equally divided 
amongst them.  And is my will should my son Simeon die having no 
children, that at his decease the bequest above made to him shall redound 
to the heirs, sons and daughters of his brothers and sisters to be 
equally divided amongst them, share and share alike.  And lastly declare 
and make known that John Wm Provance, Patience,[comma?] Boice, and
Mary 
Brewer, have each respectively received to the full amount I propose 
giving them with the exception One dollar to each current money of the 
United States, payable at my decease, and I make, constitute, and ordain 
Nathaniel,[comma?] Danell, David Provance, and Elisha
Provance, Executors 
of this my last will and testament, hereby revoking and making null and 
void all wills by me at any time heretofore made.  In testimony thereof I 
the said Joseph Provance to this my last will and testament, consisting 
of one sheet of paper have set my hand and seal, August the twenty first 
day one thousand eight hundred & thirty three.  Joseph Y. Provance (seal)

For as much as it hath pleased Almighty God in the dispensation of His 
allwise and merciful Providence to take out of this world the soul of my 
deceased daughter Uanna on the twenty fifth day of February A.D. one 
thousand eight hundred and thirty five, One of the legatees named in the 
foregoing will, to which this is appended.  Now therefore it is my Will 
and becomes my duty to give, and I do hereby set over unto my youngest 
daughter Rachel the bequest made by me to said decedant in the aforesaid 
will to which this is an appendage to all intents and purpose.  In 
testimony thereof I Joseph Provance have set my hand and affixed my seal, 
this sixth day of October, A.D. 1840.

And further it is my will and desire that so much of my former will as 
respects the land I gave to my son Uriah and my son Theron is hereby 
revoked, and the tract of land on Dunkard Creek in Greene County, 
Pennsylvania which I gave to my son Theron in my former will, I now give 
and bequeath to my son Uriah, And fifty acres of land, part of my home 
farm, which I formerly willed to my son Uriah, I now will and bequeath to 
my son Theron.  In testimony thereof I Joseph Y. Provance have set my 
hand and affixed my seal this 2nd day of March 1843.  (Will proved on 6th 
June 1843)

And now to wit.  4th Dec. 1843 on David Provance Executor of the last 
will and testament of Joseph Y. Provance dec'd to shew cause on the first 
Monday of January 1844 why he should not give security for his faithful 
administration of the estate or be discharged from the execution of the 
same.  Rule ips March 4th 1844.  Rule renewed to June term 1844.

Bedford Co. which may correspond to Nicholson TWP of Fayette Co.  Married 
to Sarah Yardley (living 1781 in Green TWP, Washington Co.).  Children:

Samuel a taxpayer in Greenwood TWP, Cumberland Co. 1778

John William received warantee of land in Bedford Co. Oct. 11, 1771 and 
served in revolution.

misc.  - Cyclopedia of Fayette Biographies by Ellis (?)

p. 521  James M. Provance was born in Nicholson township, Fayette county, 
Pa., March 23, 1849;  was reared on a farm, and attended the common 
schools.  At the age of thirteen, he commenced to make his own living as 
deck sweeper on a steamboat, which he followed for one year, when he 
shipped as deck hand, after which he worked as a fireman for some time.  
He was engaged upon the river for about ten years, when he engaged in 
mining coal.  Afterwards learned the trade of stone mason.

In 1872 he was married to Mis Mary M. Romesburg, a daughter of Adam 
Romesburg, who was a native of Pennsylvania, and of German descent.  Mrs. 
Provance died Sept. 4, 1887.  To this union were born five children: 
Alfrida, Isa D., Della, Harry B. and James L.  Alfrida is married to 
Daniel Davis of Fayette County.

Mr. Provance owns a comfortable little home at New Geneva.

Theron Provance, the father of the subject of this sketch, was born in 
Fayette county Pa., owned a small farm, and had a comfortable home.  His 
father, Joseph Y. Provance, was one of the early settlers of western 
Pennsylvania, and was a large land owner.  He was of English birth, and 
came to America, and settled in Pennsylvania before the revolution, and 
took part in that war.  He was the father of twenty-seven children.

	Captain Jesse Provance of English Descent, son of David & Agnes 
(Hartly) Provance.  Grandfather owned celebrated Provance Bottoms.  [I 
assume this is Joseph Y. Provance]  David a native of Nicholson TWP, had 
16 children.  Captain Jesse Provance was proprietor of the Provance 
House.  Married Hester Miller , dau. of Benjamin Miller.

The subject of this discourse is Joseph Yard Provance, born March 31, 
1764 in that part of Virginia that was disputed with Pennsylvania, 
possibly then called Frederick Co., Virginia, but which now is Fayette 
County, Pennsylvania.  He is said to be the son of John William Provance 
(Provins?) who married first :Elizabeth Thompson.  John and Elizabeth are 
said to have been married in 1762.  At least one child was born: John 
Jr., who married Annalannah Anderson.  From a later will we know that the 
date of marriage and the children could not be such.  His second wife in 
her will names more than one step-child.

Elizabeth died before 1764 because John William Provance married second, 
Sarah Wright who had also been married before.  It is the belief of this 
author that this Sarah Wright is the same Sarah (Yard) that married 
Jonathan Wright a weaver from Hopewell, New Jersey.  McCracken in the 
American Genealogist Magazine recorded the Yard ancestry: Sarah3, 
Joseph2, Joseph1 Yard a stonemason who came to this country about 1669 
and built churches in and around Philadelphia.  Joseph Yard2 had a 
daughter Sarah, born ca. 1724 who married Jonathan Wright.

John William Provance and Sarah (Yard?) (Wright) were the parents of 
Joseph Yard Provance.  We are also certain that Sarah had a son Benjamin 
by a father named Wright.  This Benjamin had a daughter who married 
Gideon Long, possibly of Washington Co., Penna., about 1803.  Her name 
was Elizabeth.  It is believed that Benjamin Wright married Sarah 
Casto.   The Casto name is prominent in this family.

Joseph Yard Provance married first: Elizabeth Casto, daughter of David 
Casto.  She was born in 1765 and died in 1818.
